Nigeria’s Labor Laws

Nigeria’s legal system is largely based on British common law, with some local customary and Islamic influences. The main statutes for regulating labor and employment are found in the Constitution of the Federal Republic of Nigeria and the Labor Act. It’s important to be familiar with some of the main points of law in these and other instruments so you can work with your PEO to maintain legal compliance in Nigeria.

1. Employment Contracts

Employment contracts in Nigeria can be oral at first, but all workers must be given written contracts within three months of starting work for their employers. Fixed-term contracts are allowed and are not strictly controlled, which means that their durations, extensions, and renewals are at the discretion of the employer.

2. Working Hours and Overtime

In Nigeria, employees generally work a regular workweek of 40 hours. There are no laws mandating limits to overtime or rates of pay, so these are simply agreed upon in individual contracts.

3. Minimum Wage

The national minimum wage in Nigeria is 70,000 NGN (Nigerian naira) per month, or around 48 USD. This minimum protects all workers in all industries, including those on probation.

4. Employee Benefits

Nigerian workers are entitled to annual paid leave, paid public holidays, maternity leave, and sick leave. Workers must receive a full 24-hour period of rest each week, and at least one hour’s break in a shift that lasts for at least six hours.

5. Payroll Tax and Social Contributions

Employers in Nigeria have to calculate and withhold their employees’ personal income taxes, then pay them to the FIRS. Workers pay between 7% and 24% of their earnings in taxes, depending on their income levels.

Employers have to contribute the equivalent of 1% of their employees’ earnings to the Nigeria Social Insurance Trust Fund (NSITF). If they have 15 or more employees, they also need to contribute to pensions through Pension Fund Administrators (PFAs). The employer has to pay at least 10%, while the employee pays 8% of their earnings.

6. Termination and Severance Pay

Employers have the right to summarily dismiss workers for gross misconduct, but must otherwise provide reasonable grounds for terminations. Employers and employees must provide notice, with periods that range from one day (after three months’ service) up to one month (for at least five years’ service). Severance pay is not mandated, but can be included in individual contracts.

7. Foreign Workers

According to the Nigeria Immigration Service, foreign employees can work in Nigeria with the correct visa, typically an R2A Employment Visa. To obtain this visa, the employer must first obtain an expatriate quota approval, offer the employee a job, and receive an acceptance letter from the employee. Once the employee receives this visa and enters Nigeria, they must apply for a residence and work permit that can be extended every two years.
