Mexico’s Labor Law

Mexico’s legal system is largely based on Spanish civil law. The Federal Labor Law contains most of the regulations that affect employment in the country, including these important rules:

  • Employment Contracts: Contracts in Mexico can be for fixed terms for non-durable work or worker replacements. There is no maximum duration for fixed-term contracts, but they must be related to the scope of a project or specific task.
  • Probation periods: Probation can be used for contracts longer than six months in duration. They can last only 30 days for regular workers, and up to 180 days for managers, administrators, professionals, and specialized technical workers.
  • Working Hours and Overtime: Mexican workers work a regular 48-hour workweek. They can be required to work up to three hours of overtime three times a week, or nine weekly hours, and must be paid double their normal salaries. If they work more than this, they must be paid triple.
  • Minimum Wage: The minimum wage in most of Mexico ranges from 278.80 to 624.30 MXN (Mexican pesos) per day (around 15-34 USD). In the Northern Border Free Trade Zone, wages are higher, and the minimum ranges from 374.88 to 624.30 MXN per day (around 20-34 USD).
  • Termination and Severance Pay: Mexican workers can be terminated immediately, though the employer must provide a written notice to the employee upon dismissal to make the dismissal justified. Workers are usually entitled to severance pay, which is normally three months’ salary plus 20 days’ wages for each year of service.
  • Foreign Workers: Employers who want to hire foreigners to work in Mexico must sponsor their work permits so they can apply for Temporary Resident Visas. Upon arrival in Mexico, they need to obtain Temporary Residence Cards from the National Migration Institute (INM).
