Indonesia Labor Law

Indonesia follows a civil law system heavily influenced by Dutch civil law and local traditions. It includes extensive regulations that protect both employers and employees. Some of the most important elements to be aware of include:

  • Employment Contracts: Employment agreements in Indonesia can be either permanent (indefinite) or fixed-term (definite). Fixed-term contracts can be made for two years, extended once by one year, and then renewed for two more years, for a maximum duration of five years. Probation periods can be legally added only to permanent contracts and can last up to three months.
  • Working Hours and Overtime: Indonesian workers usually work seven hours a day, six days a week or eight hours a day, five days a week, for a regular workweek of 40 hours. The standard working week is 40 hours, typically divided over five days. Overtime must be agreed to by the employee and is limited to three hours a day and 14 hours a week. 
  • Minimum Wage: The minimum wage in Indonesia was last updated in January 2026. Rather than a single, national minimum wage, Indonesia sets minimum wage levels by location and industry, with a range of between 2.17 and 5.4 million IDR (Indonesian rupiah) per month (around 130 to 326 USD).
  • Employee Benefits: Mandatory benefits for Indonesian workers include religious holiday allowance (13th-month salary), annual paid leave, maternity leave, and sick leave. Employers and employees both contribute to social security programs that provide healthcare, accident, death, old age, and pension benefits.
  • Termination and Severance Pay: Employees can be summarily dismissed for gross misconduct or if they’ve been detained by the authorities for over six months. In other cases of dismissals, the employer must give seven days’ notice during probation and 14 days’ notice normally. Employees must provide 30 days’ notice of resignation to their employers. Dismissed workers may be entitled to severance pay and length of service pay of between one to ten months’ salary each, depending on seniority.
  • Foreign Workers: To hire a foreign worker, an employer must prepare a Foreign Worker Utilization Plan (Rencana Penggunaan Tenaga Kerja Asing or RPTKA). Once this is approved by the Ministry of Manpower, the employee can obtain a limited-stay visa (VITAS) from immigration to enter Indonesia legally. Once in the country, they must convert their VITAS into a limited stay permit (KITAS).
